Siow Chan Wai, Shawn is the Managing Partner of Y Kong, Wong & Partners and a distinguished member of its Litigation Department. His practice spans a broad range of litigation matters, with particular focus on employment law, defamation, breach of trust, and commercial fraud. He has also been expanding his practice into corporate litigation, with particular emphasis on liquidation-related matters. - Acted for a Malaysian franchisor in a major AIAC franchise arbitration involving territorial exclusivity, termination issues, refund claims and asserted loss-of-profit damages in the region of approximately RM48 million.
- Represented PRC manufacturers, traders and equipment suppliers in a series of cross-border recovery actions before the Malaysian courts, including claims for unpaid purchase price, storage charges, delivered goods and other contractual sums.
- Acted in a portfolio of debt recovery and enforcement matters for trade and hardware-sector clients, obtaining multiple default judgments and a consent judgment while managing more complex running-account and property-linked recovery disputes.
- Led strategy in a multi-layered commercial dispute involving loan repayment, personal guarantee enforcement, asset repurchase obligations and post-termination unwind arrangements arising from a collaboration breakdown.
- Acted for a contributory / holding vehicle in resisting a winding-up petition founded on a disputed invoice debt, in the context of a wider cross-border corporate control dispute involving parallel foreign proceedings.
- Acted in contentious intellectual property matters, including trade mark invalidation / bad-faith registration disputes, and secured a favourable interlocutory outcome with costs for a Malaysian trade mark proprietor.
- Regularly acts for SMEs, contractors, developers and private business owners in contractual and technical commercial disputes across sectors including construction-linked supply, building materials, household products, automotive accessories, mobile-device retail, mining and industrial raw materials.
